Spouse eligibility for ILR at the same time as main applican

Post by tcsprak » Mon May 11, 2015 1:28 pm

Hi,

I am going to apply for my ILR in the month of August 2015. I presently have a Tier 1 General visa. My wife came here to UK as a Tier 1 General (Dependant) in April 2012 and had to be outside the country for about 7 continuous months (May 2013 - Nov 2013) and also for another couple of months before that (Feb 2013 - Mar 2013) .

However, she has never travelled outside of the country since Nov 2013 and her overall period of stay in the UK is more than 2 years .

The questions are:

1) Is there a requirement for any continuous period of stay rule for dependants as well or is it only for the main applicant ?

2) Can she apply at the same time as me ?

3) Can she apply for ILR dependent application from India as well if need be ?

Thanks,
Pravs

Moderators,

Please advise as appropriate or atleast point me to previous posts that are similar in nature. I tried to search but couldn't find anything relevant.

Thanks,
Pravs

The spouse's requirement is 319E.

Thanks Vinny !

I guess if I can produce proof of cohabitation for the last 2 years surely that should be enough for ILR eligibility in my case as its not necessary to have continuous residence in UK ?
