UK VISITOR VISA REFUSAL WITH NO REASONS GIVEN

Post by v4vikramrana » Wed May 13, 2015 3:13 pm

Hi There,

I have applied General Visitor Visa for my sister and her two kids on 13th April 2015 and interviewed on 24th April 2015. There visa was refused on 06th May 2015. The kids were refused citing their mother's was refused.

However, for my sister's visa they have not provided any explaination. Please see the provided refusal letter in this post

I had provided following documents

Sponsor (Me)
- Employment letter
- Six months payslip
- 3 months bank statement (>5000GBP)
- Utility bill
- My UK permit copy
- My passport copy
- My sponsor & invitation letter for them
- Air tickets (Paid for both to and fro)
- Tax return form

My Sister
- Employment letter
- Six month payslip (Monthly salary - 329 GBP/month)
- 3 months bank statement (639 GBP closing benefit)
- Fixed deposit certificates (10,000 GBP value)
- Letter of FD source (My parents gave these to my sister after the land was acquired)
- Copy of land sale certificate
- Vacation letter approval from her school
- Marriage affidavit
- Consent letter from father for the kids
- Marriage photograph
- Cover letter
- Finance plan letter citing what funds are for what expense (I am the prime sponsor but if required she will use the FD to suppor therself)
- Her Last years tax return form
- Letter from my parents confirming the FDs as gift to my sister and their persmission for her to use, if needed
- Passport copies of my parents
- Passport copy of my sister
- PAN Card copy of my brother in law (he does not have passport)
- Indian driving license copy
- Cover letter of why he is not travelling
- His employment letter (He is a contractor and do not wish to travel due to flight scare)

Despite submitting all of the above documentation that meet the requirements, my sister's visa was rejected. What is more frustrating is the refusal letter do not talk about anything. The paragraph section are still left as [XX] and no reasons are given. Also, the ECO name on the back page is left blank.

The refusal letter of my nephew, niece have the refusal letters properly filled out with relevant paragraphs names mentioned and even have the ECO name.

Therefore, I feel the particular ECO did not really look at my sister's application. I have been told i cannot appeal for visitor visa. Therefore, I am thinking to

1. Reapply immediately from a different location (Gurgaon center)
2. Also, I feel the rejections in Delhi, Nehru place is unusually high. Why would that be?

Please note, last year my parents were rejected twice before they were granted third time. However, during the two rejections valid reasons were given.

I will appreciate if you could advise me if i should reapply and if anyone could think of the rejection reason based on the refusal letter and documents I have provided.

Also, if others have got similar refusal letters

Appreciate your help in advance.

Regards
Vikram

That's weird. Are you sure there is no 2nd page? Have you tried contacting UKVI and possibly send them an email? What is your status in the UK by the way?

Hi EDWINUK,
Yes, It is really frustrating. It was only page. I have uploaded the back of it. It does not even mention the ECO officer's name.

I have attached the letter of my nephew that states the reason and right paragraphs, etc.

I called (1.37GBP/minute)the UKVI people but they are asking me to fill up an SAR and send to an address. I am assuming that process will take ages.

I am planning to apply again. The only thing i can see in my application is finance details

I filled the following for my sister

1. Do you have savings, properties, or other income - NO
2. How much do you spend monthly on living - 60 GBP ( I have mentioned it includes the money spent on kids 20, 20, and 20 on herself in India. My brother in law affords himself based on his salary)
3. How much of your total income goes to family members - 40GBP (20, 20 for the two kids)
4. Total cost to you personally for the trip - 0 (As i am the sponsor)
5. Total amount of money you have for this trip - 10,000GBP (I have referred here to the two FDs. however, her bank statement is around 629 GBP). Can this be wrong?
6. Cost of airplane ticket - 500GBP (i paid for it)
7. Cost of your accomodation - 0 GBP (As she will be living with me)
8. Cost of living expenses - 500 GBP (I am putting this in reapplication assuming 20 GBP/day for 25 days)
9. Is someone else paying for trip - Yes
10. How much money - 5000GBP (I have this much in my normal account)

In addition, my sister has provided two documents
1. Letter of employment confirming salary from her school - Shows her ties
2. Vacation approval - the latter states that her leave from date 1 to date 2 is approved for a trip outside to India

Therefore, in my opinion, it shows sufficient strong ties. Is it worth attaching any other document ?

Please confirm

Regards
Vikram

I could only assume that the others have been refused because of their mother. Can you post the full refusal text from the mother?

I also noticed that even though you provided your financial status, you have not provided proof of accommodation?

Have you provided proof of the things you answered on their financial status? If you are sponsoring them, are you not providing their accommodation as well?

Hi EDWINK,

I have attached the refusal letter for the mother in the first post. However, i will write it here again...

THE DECISION
I have refused your application for a visit visa because I am not satisfied that you meet the requirements of Paragraph[XX] of the UK Immigration Rules for visitors. This is because:

That's it. The refusal text says nothing else. It is annoying. I have checked again with them. They do not have any more papers. Each application came with 1 page refusal letter. the front thad the decision and the back has refusal date box. I also noticed there is no mention of your right to appeal is limited, etc.

For my proof of accomodation, Sorry i forgot to right. I have submitted my utility bill (NPOWER) for my last month. Should i submit anything extra? Council tax? The council tax is on me and my wife name. In that case, would i need to submit her passport copy and visa details?

I have provided proof for their financial status.
1. Bank statements of hers (last 3 months) - Last balance (630 GBP)
2. Salary statement for 1 year
3. My bank statement showing 5000gbp available
4. my Salaray satement
5. Fixed deposit certificates on her name (5000GBP per certificate; two certificates)
6. Letter from my parents confirming the money in the FD came from them and it belongs to my sister now as the FDs are on her name.

I have tried hard but i am not able to think of an issue in my application. I have been in UK since 2011 on a tier 2 visa long term.
my wife is also on a similar visa and is not dependent on me

I am planning to reapply. what do you think? Hopefully, i will know the reasons at least? I am assuming such a case has not happened before.

Here is what I will do in your case;

1. See my post on your previous thread regarding the financial status questions.
2. With regards to your accommodation, include everything i.e. title, council tax, survey or proof to show how many rooms.
3. You and your wife can sponsor them and provide individual Sponsorship undertaking. You can download a from from the UK website.
4. Provide your payslips, employment certficates, employment letter.
5. Yours and your wife bank statements.
6. Photos of you and your sister and her kids if you have some.
7. Invitaion letter.
8. A statement from both you and your wife explaining everything, your circumstances/status. Would also be good to explain the lumpsum deposits you made.

1. Thanks a lot for it. It is big help.
2. I will add council tax details. About the rooms, I could attach rental agreement copy. Although, I did not need them last time. I suppose I attach them to all 3 applications
3. Is there sponsorhip form? Also, I want to sponsor alone and not involve my wife. Will that be a problem?
4. I have those
5. I have my statements.
6. I can add a photo but it shows my parents, me, her, and her kids but not her husband. we have separate photos of her, my brother in law, and myself. I guess i could add that.
7. I have
8. I guess this is the coverletter. But, I will update it and get it signed by both me and my wife. In additionl, i will add her passport and visa copy

What do you think?

3. Is there sponsorhip form? Yes there is one I found though I think it's obsolete from UKBA but it was accepted and I only sent our application 24th of April and got it approved this morning.

It is always best to have more sponsors especially seeing as you are sponsoring 3x persons. Is your wife currently working?
