assistance needed urgently

Hi
Please I need an urgent advice......
My friend is a STAMP4 holder and married to British national and wishes to move over to the uk..
But acquiring a reunion visa has be come a nightmare..
Then came up with the idea of changing his STAMP 4 to EUFAM since his wife is an EU national the issue is that his wife is not working due to health reasons can the application be made on sufficient resources as he is in full time work?....

Some one please give any advice on this..

If the British citizen doesn't have Irish citizenship as well (many do!), they will be able to apply for an EEA family permit as long as they are not looking to get help from the UK government, i.e. self-sufficient. They will not need to prove anything for the first 3 months of being in the UK, but, after that, they will need to have comprehensive sickness insurance.

If your friend acquires a Stamp 4EUFam in Ireland for five years, that permission is only valid in Ireland and would not be valid in the UK

SORRY: I JUST REALIZED THAT I MADE A MISTAKE! I DIDN'T REALISE THAT THE BRITISH CITIZEN WAS NOT WORKING IN IRELAND. IF THEY ARE NOT WORKING IN IRELAND THEN THEY WOULD PROBABLY HAVE AN ISSUE WITH GETTING THE EEA FAMILY PERMIT.

IT WOULD BE BEST IF THE BRITISH CITIZEN COULD WORK IN IRELAND AND THEN THEY WOULD QUALIFY UNDER SURINDER SINGH.

Besides we all know of the recent uk legislative update..
Maybe you need to read before advising people wrongly..
Just to update you 4 EUFAM is valid in the Uk and any other part of the eu..
The holder do not need any form of documents to work or settle there in as much as the eu spouse is travelling or moving there with them.

If a person acquires a residence Card stamp 4EUFam for 5 years for example in Ireland. That residence card is only vaid in Ireland, it is not valid in the UK or any other EU State. That is not a mistake and it is not an error on my part. If the Stamp 4EUFam holder and the EU citizen then move to another EU State, they have to apply from scratch in that State.

Hi Leinster,
I think your advice is wrong i agree with aganty , if you have stamp 4 euF ( 5 years ) you will be able to go to Uk bcz the law has changed from the 11 of April .

It is valid for travel for the UK, but not to reside and work. The stamp 4EU Fam permission issued in Ireland allows that person to reside and work in the State and only in this State, not any other EU State. Regarding travelling to the UK for a visit, it is of course valid.

An Irish Stamp 4 EUFam will let the non EU citizen enter the Uk and stay for up to 3 months as a tourist. It will definitely not enable them to work or settle in the UK.

Your friend can enter the UK using the Stamp 4 EUFam, but will still need to apply for a UK residence card to work or settle there.

Well please just don't miss lead people seeking help on here..
Only advice on what know, not what you think and sometime do go read before trying to advise some one cose from what you saying it seems you still far behind probably on uk previous legislation but it's ok maybe u need to read the 06/04/2015 uk legislation update on eu family immigration sure that will enlighten you both..

You are confusing right of admission and right to work/settle. Nowhere in the announcement of their new policy are the UK saying you can stay and work there with an Irish residence card. They are only saying you can enter the country.

If you choose not to believe this noone here will stop you, but I strongly suggest you read the documentation again before telling your friend they can settle in the UK with an Irish residence card. Nowhere will you find this written down.

I fully concur with jeupsy. Right of access to visit and right to reside and work are two very different things. You sought advice and this is the advice given.
