British Citizenship for my 2 Children.

Post by alusto » Thu May 14, 2015 2:23 am

I am the father of my two children and I am a British Citizen (By Descent). I brought them to the UK on February 15 2015.

The first child Was Born on 4 March 1997 so he is now 18 but was Under 18 when we moved here.

The Second Child was born on 14 July 1999 and is still 15 turning 16 in a few months

How long will they have to live in the UK to be eligible to apply for the Citizenship? Thanks.

I don't think that they will qualify under 3(5) before they turn 18. Do they qualify under 3(2) (British by descent)?

Probably best for them to naturalise as adults, when eligible. This makes them British otherwise than by descent.

I read somewhere, that since they have a family settlement visa, that aslong as they come into the country under 18, they only have to live 3 years to get citizenship?

That would be true if they were still minors after living in the UK for 3 years (3(5)).

Minimum 5 years, if not the spouse/civil partner of a British citizen.

Is it 5 years and they will be eligible for The passport? Or will they also have to live 1 year with ILR?

They have to have held ILR for at least 12 months before applying (unless spouse/Civil partner of a British Citizen)

They will need to apply for naturalisation first, only once this has been granted will they be able to apply for a passport.

When Will I get my British Citizenship?

Post by alusto » Wed May 20, 2015 2:32 am

I moved to the uk on the 15th of February 2015 with a Settlement visa for accompanying Mother. My father is already a british citizen by decent so we got Settlement visas to come live with him here.

My birthday is on 14 july 1999 so Im currently 15 years old turning 16. My question is, how long will i have to live here to get Nationality or ILR?

Thanks.

At least two years in UK and should be free from immigration control, i.e. have either PR/ILR/ILE.
Being British is a state of mind.
