Tier 2 General_Eligibility_Confused

Hello Dear Experts,
I had traveled to UK on ICT - Short term Skill Transfer visa and the details are mentioned below

---> 'Work dates' in COS are mentioned as 24/08/2014 to 21/02/2015.
---> Was given Skill transfer visa from 18/09/2014 to 17/03/2015
---> I was in UK for only 2 months from 01/10/2014 to 30/11/2014 and left UK on 30th November 2014.

I am planning to find a sponsor for Tier-2(General). Does the cooling off apply in my case?

As per recent changes in rules, since i have stayed only for 2 months, am i exempted from cooling off? Kindly answer.

Yes, you are right. You are exempted from cooling off period...

Good luck in searching for a sponsor.

you would only be exempt from cooling-off if the period of engagement stated in the T2 ICT ST CoS had been 3 months or less

Does this mean that my ICT ST COS has been issued for more than 3 months and cooling off will apply to me.

I think cool-off will apply for you since your CoS was more than 3 months.

Hello Moonlight,
A company is ready to sponsor me on Tier - 2 General. My doubt of cooling off period is it applicable even in the case of Tier-2 General visa as well. I am under the impression that if i am planning entry to UK using ICT route, then cooling off will apply. Kindly correct me if i am wrong.

Cool-off will apply in any category of Tier 2 visas except if you are applying for Tier 2 ICT Long Term Staff visa and your current visa is either ICT Short term or skill transfer visa.

In your case, since you will apply for Tier 2 General, cool-off will apply. For details of cool-off period, read section 39.34 from sponsor guidance: https://www.gov.uk/government/uploads/s ... _04-15.pdf
