Tier 2 - Can I work full time if I've been made Redundant

Post by Immigrant22 » Wed May 20, 2015 10:18 am

I have a Tier 2 (General) Leave to remain permit - Restricted Work

Recently the studio that I was working at closed down and I was made redundant. According to what I've been able to read/understand my visa is directly connected to my sponsored employer. It seems that I'm able to work full time with my sponsored employer and up to 20 hours with another employer that is not tied to my visa.

Now that I've been made redundant do the same rules apply? Meaning if I have been made redundant...
1. Am I only allowed to work full time with my original sponsored employer and only 20 hours with someone else?
2. Am I allowed to work full time with a new employer using my current visa, since I've been made redundant? I understand that I need to find a new sponsor and obtain a new visa that is connected to my new employer, but in the mean time can I still work for someone else using my current visa till I find a sponsor, before my visa expires/is invalid?
3. Am I forced to be unemployed till i find a new sponsor and all the paper work is done?
4. Once I find a sponsor can I start working for them right away or do I have to wait until they give me my new CoS? Or do I have to wait until I receive my new visa/work permit?

Thanks so much for any feedback answers.

1. Yes. The additional 20 hrs is optional and u can do it only in the same role the original CoS was applied for.
2. No. The visa is sponsor specific and its illegal to work for another employer on the visa.
3. Unfortunately, Yes.
4. You will have to wait until your visa is approved.

Moonlight55 - I have a quick clarification/question - on Question 1) - So I can work for a new employer for 20 hrs a week as long as its in the same role as my current CoS , even though I've been made redundant? Then obviously once I obtain a new visa with my new employer I can then work full time.

Unfortunately, No. The additional 20 hrs are just supplementary hours in addition to your primary work. You cannot work those additional 20 hrs without your primary work. You will have to wait until you commence your primary work again (with the new sponsor) to work those additional 20 hrs.
