As a business owner, can I sponsor family for Tier 2 visa?

Post by wedgehead » Thu May 21, 2015 11:20 am

I am a naturalised British citizen from the Philippines and my husband is British. We have just acquired an established restaurant as its new owners. I would like to bring my brother, who is in the Philippines, to work for us. He studied hotel and restaurant management in university in the Philippines and is also a trained chef. As a close family member, can we apply to be an employer sponsor for him so we can bring him to the UK to work for us?

You would need a sponsors licence and proof that no suitable local or EU applicant could be found and some sort of evidence that this is not an attempt to circumvent the immigration rules, which it certainly looks like.

We can, as a company, apply to be a sponsor.

The job of a chef is the list of shortage occupations.

I think my brother is well-qualified-- he is a trained chef and has a masters degree in culinary arts. The reason we want to bring him to the UK is obviously because we want to run the the company as a family business.

Does anyone know if there are restrictions whether the Certificate of Sponsorship can be offered to a family member, of course taking into consideration, the person's suitability for the job offered?

how many years of experience has your brother got? U do realise that you will have to pay him £30k salary. this is excluding the accommodation and any other allowances besides paying the employer's NI.

you will be heavily sucrutinised by home office as well since they are likely to say that this type of business does not need a NON -EU person.

IMHO

There is no work permit for family member visa - will be judged purely on whether there are or aren't any local/eu/other suitable applicants and why you seem to have earmarked a specific person who happens to be a relative.

Sorry, but this will set off all the UKVI arms bells at once.

If you have an established business what happened to the original chef and why do you need one specifically from PH?
