Overstayer and wants to marry

Hello Everyone

We are bit in dilemma and need guidance!!!!

My situation: currently I am on ILR and have applied for British passport

My gf situation: she got tier 2 (general) in 2012 for 3 years. Due to some circumstances she was made redundant in May 2014 and as a good will gesture she was told they will not cancel her sponsorship until she gets a new sponsor. She did got new job and they ready to sponsor too. However when my solicitor got file copy of her HO was informed about her by her previous employee and it does state HO has send recorded delivery in Sep 2014 informing about this. Which we have not received but no way to prove that. Her Biometric showing visa expiring in June 2015. So what we can we do here?

We willing both to go to India and marry there but as her status shows as overstayed will that cause any issue when she apply for dependent visa?

I have my own house and earning over 19000. Neither of us have any criminal conviction
