Hello all

My first post. :)

I have very recently applied for spouse visa. I am the sponsor.
I applied using 6months payslips cat a. With the same employer for over 7months.

I was just reading through the guidelines again and feel i have made a mistake :( i know its probably too late to do anything now but it is really bugging me now so i wantes your help.

I am paid at an hourly rate therefore classed as non salaried. I had a pay increase two months into my job. This has been mentioned in my employer letter.

I now believe i should have applied using cat b variable income??

Please can someone help clear my doubt. TThank you.

if at the end of the day you still meet the requirement, the ECO may well ignore your error, if he or she is a reasonable.

Thanks for your reply obie.

Does this mean i should have used cat b then? I did provide my p60 and p45 for the previous year so maybe this could work in my defence? (I didn't meet the income threshold last year but i have plenty of savings that would make up the shortfall)

I know it depends on the eco but in your opinion do you feel this may be a reason for refusal? If yes, if i appeal the decision and show 12 months previous statements do you think the appeal could be overturned?

As you are non salaried Cat A is fine. If your average income in the last 6 months was £9300 you have met the requirement so nothing to worry about.

I sponsored my husband using Cat A and non salaried employment - the calculation for is slightly different and stated in the rules.
