Re - Spouse settlement visa for my husband.
The background to our case is my husband applied for spouse visa which was rejected under the grounds that we didn't meet the financial requirements. I earn £19k per annum which my payslips and employer letter showed. The visa was refused because I was paying part of my salary into my account and using part for general expenses, therefore payslips didn't match bank statements. I didn't take legal advice first time so wasn't aware of the rule. Anyway after we got rejected I took legal advice and was advice to pay all my salary into my account which I have been doing for past 7 months.
We appealed the decision and at the appeal provided new payslips, bank statements showing full amount deposited, p60s, HMRC letter, employer letter, employer's accountants letter, student loan repayment letters. The appeal was also dismissed. As we didn't provide correct documents showing full deposits at the time of the application.
Anyway we are going to reply with the same documents that were submitted at the appeal.
My only concern is because I get paid in cash on the 28th of each month or the preceding working day if the 28 falls on the weekend or is bank holiday. If I get paid on the 28th I can't deposit the money into my account same day because I finish work at 5:30pm and work outside of the city. So I deposit the full salary into my account on the 29th. On other occasions if the 28th falls on Saturday or Sunday I get paid on the Friday, again I can't deposit the money into my account as I finish work at 5:30 pm. In such an instance I will deposit my salary on the Monday morning on my way to work. For the December month the 28th fell on Sunday and Thursday and Friday 25 and 26 were Chrismas bank holidays. So I got paid on the 24th but I couldn't deposit the money on the 24 because I finish at 5:30. I couldn't deposit the money on 25 and 26 because of bank holiday and 27 and 28 were weekend so I waited until 29 Monday when I was back at work to deposit the money.
Would me not putting the money into my account the day I get paid be a problem?
Also I get my payslips on the day when I get paid but the payslips always show the last day of the month. Sometimes the date on the payslips is a weekend day. I asked my employer about this and he told me the payslips are prepared and printed before the date shown on the payslips, therefore the date on the payslips doesn't reflect pay date. For example I get paid on the 28th and get my payslip, I deposit the money into my account on the 29th but the payslip shows 31st. Note my employer has outsourced his payroll to his accountants.
Could this be a problem?
