Urgent Clarification On Varying an Application

Hello everyone,

The question is genuinely for a friend of mine and would be great to anyone who could put their input.

She has been in the UK for 6+ years and her last application was for student visa where she had revoked 60 days letter, unfortunately she varied her application and applied for FLR (O) which i believe wasn't wise step.

Now in her refusal Home office has counted her stay in the UK as 4+ years which isn't correct. Can anyone explain is it because she varied her last visa application, that's why HO also didn't include a year where her application was pending as Tier 4 Student.?

It is not home office writing something on a paper, that confers rights. If the law say there is a right, then irrespective of whether Home Office mentions it on a letter , it exist.

If she had a visa and applied for extension before it expires, he lawful residence is extended until a decision is made.
