Hi,

I am currently on Tier 2 leave with a NQF 6 SOC Code (2123)

Can I apply for an extension at a lower NQF level at NQF Level 3? The code I am planning to apply is 3113 and it appears on the shortage occupation list. A note on the below HO document (page 9) says jobs are considered to NQF level 4 is they are shortage occupation list.

So my question is, can I apply for a Tier 2 extension if I move to a soc code which has a lower NQF level? My current soc and the one I am thinking of moving to both appears in shortage occupation list.

Further to my above post, some more info:

I entered Tier 2 after June 2012 rules after that date applies to me.

I am in SOC 2123 now which is in a Shortage Occupation list +NQF Level 6

I now have to extend and want to apply with SOC 3113 which is also on Shoratage Occupation list. Its listed under NQF level 3 but the jobs under shortage occupation list in this code are regarded as NQF level 4.

So basically, I will be applying for an extension with a job code that downgrades from NQF 6 to NQF 4. Now, in some docs I read that for a T2 extension the threshold is NQF level 6. But then it also seems like that threshold can be exempted if the job appears in shortage occupation list. I am struggling to establish a solid understanding here.

Please someone help me with your knowledge!

Hi people, if you could share your knowledge/advise that will be great great help for me please. Manci have been helped me here before - your inputs are much appreciated please.

Since Sep 2013, I have Tier 2 General leave with the CoS SOC Code of 2123 (NQF Level 6 + Shortage Occupation List). This leave expires soon and I need to extend my visa.

Issue is I don't qualify for the experienced salary threshold for 2123 yet. My employer is willing to offer me a different job role which falls under SOC Code 3113 which is a NQF Level 3 but falls under Shortage Occupation List. My understanding is NQF Level 3 jobs are considered to be NQF Level 4 if it appears on Shortage Occupation List.

My question is, while extending Tier 2 visa, can I apply to extend with lower NQF level SOC code/CoS (i.e. move from NQF 6 to NQF 4)? I know the skill threshold is NQF Level 6 for T2 General but I have heard/read that exemption applies if the job is on the Shortage Occupation List. Could you please kindly confirm/share your knowledge? Your time and assistance is much appreciated.
