Tier 2 Extension, English Language

Post by Echoes » Thu Jun 04, 2015 11:10 am

Hi,

I'll be applying for my Tier 2 General extension early next year. I took IELTS to prove my language skills in my initial entry clearance application. I am a bit unclear if I'll have to take the test again as my planned extension application date falls outside the transitional arrangements window. Can anyone advise please? A link to relevant rules/guidance would be much appreciated.

Many thanks.

I think for extension applications, you need not show the english language requirements again. Pasted below is the text from T2 guidance (Para 160). Please read it for more details.

You will be awarded 10 points for English language where you have met the English language requirement in a previous grant of leave. This will be the case if you have ever been granted leave:
- under the Tier 2 (General) category under the rules in place on or after 6 April 2011, having provided evidence of having a knowledge of English equivalent to level B1 of the Council of Europe’s Common European Framework for Language Learning or above;

Thanks for replying moonlight55.

Yes, I read the guidance. However, in my case I was granted entry clearance in April 2013, not sure what year's rules were in place back then. Reading through the guidance, I'm inclined to believe that I have to take the test again, which is not a problem but a bit of a hassle nevertheless.

The text says that if you were granted clearance on of after Apr 2011 (which is your case), you will be awarded 10 points based on previous application.

You are right. Having re-read the document, I've realised that I was mixing up paragraphs 160 and 161. The confusion is still there, though. According to para 160, I can score 10 points without sitting the test again. But if your read 161 and 162, that makes it all perplexing as I don't satisfy the criteria laid out in these. Or do you think the Transitional Arrangements do not apply in my case?

Many thanks

You cannot satisfy all the criteria. The guidance lists various cases where points will be awarded. As long as you satisfy one of them, its fine.
