Administrative review instead of appeals

Post by heyheyheyguys » Thu Jun 11, 2015 7:04 am

I apologise if this has been discussed before -- But I saw that there's no appeal process on new settlement visas, and there's only an administrative review. Can anyone discuss their experiences of administrative reviews? Are they stricter than the appeal process? I just want to know what the difference is!

Admin review is basically a mandatory reconsideration of the decision by a ECM.

So what happens if the AR rejects your application for a settlement visa. Can you then appeal, considering it's against human rights to separate families?

Yes. However, it may get ridiculously convoluted. Even if a judge decides that you satisfy the rules, then it may be insufficient to win the appeal.

This case is different as it's not a spouse visa, but a family visitor visa..

The principle is the same. The only rights/grounds of appeal is Human Rights.
