Indefinite leave to remain are we eligible ??

Ok so may 2012 myself and husband applied for his FLR(m), got decision november2013 application was rejected as we applied 3 days after his visa was curtailed, he was granted leave to remain as a parent (10 year route), I then sent several letters objecting the descision as they had then based his application on post July rules rather than rules implemented the time we sent the application, I recieved several correspondence with no hope however I eventually submitted a comaint to the complaint section expression how unsatisfactory I found the descision as the application again was based on wrong rules, we eventually got word back January 2015 stating they are going to reconsider decision or original application, 2 week later we got word back they had granted my husband a 2 year spouse visa (extension) based of rules paragraphs 284 and 285 , it stated he can applied for indefinate leave to remain when he's completed 2 years as a spouse, however am wondering if we would be eligible to apply now as he meets all requirements for the rules they would now based the application on and we have been married for 3 years and 2 months now!
