spouse visa help

hello guys i'm new here and i need your help to clear some stuff in which i know most of you will be willy to advise.. my girlfriend have been living in uk for 4year now because she is on a student visa, she finish her bsc but doing her masters now in which she will be finishing by august. so now her visa will be running out very soon in September and i just got my divorce from my other wife approve this month, also i'm not earning unto 18600pound as required by the home office to marry my new spouse but a lawyer advise we can do joint income together which i think is fine apart from that i'm a student here in uk in which i receive student loan and grant. my question now is okay to go ahead getting married to my new spouse because her visa is running out by September and will the student loan with grant have any effect on her application. advise pls guyz thanks. forget to mention she is from Ghana not a British but me i'm a British.please please advise me not just read and ignore it an important matter for me and my girl.

You can marry in the UK, but be prepared to have your notification of marriage period extended from 28 to 70 days by the Home Office as your fiancee is a foreign national on limited leave. You can only marry in a Registry Office designated by the Home Office and you may both be subject to an interview to determine the validity of your relationship before the wedding can go ahead.

If you are both students, how much are you earning jointly per annum and is your fiancee working in excess of the permitted 20 hours per week?

thanks for you reply casa because my contract is 18 hours per week i'm allowed to do more extra hours at work in which i earn 7-8 hundred pound per month if i do more extra hour but she work only 20 hours in a week in which she earn at least 720 in a month.. so adding both income together do you think it will work and what about my grant from student loan does it affect her application.

Do you have joint income of £18,600 for the last 12 months? You can include the your student maintenance grant.

Thanks again for your reply casa, for the past 12 month i was still married to my ex-wife in which during those period i file in for my divorce, so back to the income if i add my last year pay because i was doing two job and her own last year pay i think it will be more than the £18,600. last year from both job i made £13,500 in a year so adding her own income which might be £7,000-£8,000 it above the £18,600. so do you think all is well going to apply.
