Hi Everyone,

I shall be very thankful if someones help me.

My wife's EEA Family permit visa was rejected on 10 April 2015. So its been almost 2 months now.

So now i want to reapply for the same visa, so can anyone tell me is their any specific time period in which I cant reapply visa again for my wife OR I can reapply anytime after the ending of appeal time period.

Secondly, after getting residence card in UK for 5 years, does my wife need to stay here for continuously 5 years?

Hello

I will be speaking from my experience and the more knowledgeable members will have an opportunity to say more.

If (and if) you have new evidence that you can say should be now taken into consideration and to change the opinion of the immigration officer. If such new evidence is possessed, then you can apply the same day the refusal is issued, nothing stops you. In practice (I am talking about Moscow post) it makes no difference and UKVI aims to refuse whatever comes in front of them. So I am not trying to be over negative, but reality is pretty negative.

Therefore, I can suggest to appeal. Firstly it costs 140 pounds. Secondly, it requires a lot of soul (and document) searching. Thirdly, you need a savvy solicitor. Fourthly, is waiting time, no one likes to wait!!! My experience is that appeal is a more useful way of getting the EEA Family Permit.

Bro its been 2 month now and the appeal period is over... Someone told me for re-applying i need to wait for atleast 6 month from the refusal date... so is that true?

Secondly, after getting residence card in UK for 5 years, does my wife need to stay here for continuously 5 years?

If you applied for an EEA family permit, you can re-apply now. There is no need to wait. Whoever told you to wait 6 months is wrong. Bear in mind, you will be refused again unless you address the refusal reasons that the Embassy have given.

If she gets a 5 year RC in the UK and wants to stay for 5 years that is fine (as long as you are a 'qualified person'). She doesn't HAVE TO stay in the UK and can leave the country any time she wants... I guess that what you want to ask is something different that what you have actually asked. It really depends on what your goals are. Do you/does she want to get PR in the UK? Does she want to get citizenship in the future or does she just want to float in and out of the UK conveniently without having any commitment to the country for the long term? The answers your give will determine how much time she will need to spend in the UK.

where do you live right now .. I have the same case and if you in Pakistan then we can talk on phone or skype and share our experience.
I have applied for my EEA-FP on 29th of may 2015 2nd time first time it was rejected. so waiting for the outcomes now.

what was the reason they give you in your first application and if you send me the decision they give you and what documents you submitted in your first application would help alot both of us.

Good day pips....I'm Nigerian 33yrs, residing in italy rome, I hold the Italian carta di soggiorno (permanent),on it is the following word stamp to it:"PERMANENT RESIDENCE CARD ISSUED ON BEHALF OF AN EU CITIZEN'S FAMILY MEMBERS WHO ARE NOT CITIZENS OF AN EU MEMBER STATE".... based on the fact that my mom is an Italian citizen ( holds an Italian passport ), at the moment she lives and works in the UK since last 2014. I am applying for the eea family permit to visit her in the UK. I will be submitting my documents on 22 of June 2015. I would like to know what my chances are of getting it issued. Replyz will be highly appreciated since am so anxious. Thanks.

Hello Everyone,

I got my application today and I got refusal. very strange decision I found on letter. I shared this decision to a lawyer and he said that this decision is not justifiable. last time they refuse saying that my marriage is "Marriage of a Convenience" today the decision is strange. I don't know much about EU rules according to this decision can any body lighten there experience and guide me what to do next and what supporting documents should I submit with the next application.

this is the decision as it is written as I got on paper even full stop and capital letters are same as written in the letter.

Notice of Immigration Decision

You have indicated that you have completed a marriage contract with your spouse, who also has Italian nationality, on 10th May 2014 in Karachi in Pakistan. You now wish to travel with or join your spouse in the UK. You have provided bank statements and residency permits for your spouse showing that she is normally and ordinarily resident in the USA and has been for a considerable number of years. There is no evidence or information provided now to show that your spouse has ever in the UK, utilising her Italian nationality, or that she has made satisfactory arrangements to do so now.

In view of all this I am not satisfied that I am, therefore, not satisfied that your EEA national family member is residing in the UK in accordance with regulation 6 of the immigration (European Economic Area) Regulations 2006, or that she will be accompanying you to the UK within 6 months of the date of the application, in accordance with Regulation 12(a) of the immigration (European Economic Area) Regulations 2006.
I therefore refuse your EEA Family Permit application because I am not satisfied that you meet all of the requirements of regulation 12 of the Immigration (European Economic Area) Regulations 2006.
I have also considered whether your application raises any exceptional circumstances which, consistent with the right to respect for family life contain in Article 8 of the European Convention on Human Rights, warrant consideration by the Secretary of State of a grant of entry clearance to come to the United Kingdom outside the requirements of the Immigration Rules. I am satisfied that it does not, as know circumstances that could be seen to be exceptional have been identified or put forward now. In any event I note that family life can be maintained by visits, utilizing third countries if considered necessary and is a qualified right balanced against the need to maintain effective immigration and border control. Your application does not fall for the grant of entry clearance outside the Rules.
