I just need clarifications on this issue. I want to know if i am eligible to pay home tuition fees as a family member of a UK national but i am currently on a spouse visa but not ILR

Thanks for your reply. I have gone through UKCISA website. They said you are entitled to pay home fees if you have ILR or are a relevant family member of a UK national and have stayed continuously for 3 years (which i meet). The did not indicate if the relevant family member should have ILR or not. Please help

According to UKCISA

"3: EU nationals, and family

In order to qualify for 'home' fees under this category, you must meet all of the following criteria:

a) on the first day of an academic year of your course, you must be:

an EU national; or
the relevant family member of a non-UK EU national, and that non-UK EU national is in the UK as a self sufficient person or as a student; or
the relevant family member of a UK national;

and

(b) you must have been ordinarily resident in the EEA and/or Switzerland and/or the overseas territories for the three years before the first day of the first academic year of the course (if you have not, see the Special Provision below); and

(c) the main purpose of your residence in the EEA/Switzerland (or the overseas territories if applicable) must not have been to receive full-time education during any part of the three-year period (if you have not, see the Special Provision below)."

They did not specify that the family member must be settled.

Your not a Family Member of an EU National - those are for those using EU rules. You are are under UK rules and until your are settled (i.e. free of immigration control) you pay international fees.
