Hi There People

I am British and been with my partner 2 years, as you can see from the headline we have just had a child together, a beautiful daughter born in the UK, but now we have no idea what to do, we want to make things legal and get married, as of yet we have spoke to 3 different lawyers about LTR, and been told 3 completely different stories, one said we can go ahead and get married before making an application as we have a child and the mother cant be deported....Another said make an application, when its pending get married, the other said abit of both, so many things,so many ins and outs, thats only the tip of the iceberg,any of the information we recieved about applying for LTR was different from each advisor, it is a complete headfuck, to much information and not knowing what way to go.....

Anyone care to share and maybe make thing sound less complicated please...

It is unfortunate that they have made it complicating for you. It is a process that ought not to be complicated, or at least as complicated as they have made it. Provided of course you have not got any other adverse immigration history other than the overstaying, unless there is history of deception or criminal, things should not be that hard.

Have you got any evidence of living together for a period of 2 years or more?

Hi There,

Ah thanks for your reply, we can show 2 years of being in a relationship , but not 2 years of living together, we also wanted to get married as i said, but now have found out that from March 2015, the registar at any register office must inform the home office with our documents about our impending marriage and the home office will decide in 70 days if the marriage can take place,that goes for all people who have overstayed and want to get married, it gets harder for genuine people. We are going ahead with an application for LTR, god knows what will happen, our only saving grace is our daughter, our lawyer says the mother could be deported and the child stays with me, but she thinks it would be very extreme, though thats not saying it couldnt happen, though the mother has no criminal history and i have been able to show that i have been supporting her and she is not working illegal etc....

I am afraid if the lawyer cannot give sufficient reassurance, then it is worth considering the point of staying with him or her .

I am Northern Irish, therefore i hold a British Passport, i can have dual passports, but the Irish Passport would not help as the British passport over rides it in this situation

I understand what you are saying about the lawyer, she says we have a very strong case and things can be proved that everything is legitimate, alot of proof , but as with any lawyer she says it is at the discretion of the home office, and i have seen enough stories that not everything is 100% sure and of course i may be overthinking things alittle in this situation, but i think its natural to be cautious and worried

Im in London, if i was in Northern Ireland the same rules would apply as here, nothing is any different, the only thing i might have been able to do is cross the border into ireland as an EU citizen etc, as we dont have any border control between the 2 countrys and you can drive across the border freely, but that option is dead in the water lol
