Urgent Help Tier 2 refusal

Hi Manci,

Please help me with your advice on below mentioned refusal. Should I go for administrative review in this case.

This is my first application on Tier 2 visa category out of country (Singapore), below is the refusal comment of ECO.

Kindly help me with your guidance.

ECO Comment:
You have been allocated a Certificate of Sponsorship (COS) under tier 2 (General) New hires - restricted, to work as a Solution Designer for xxxx Limited. Your COS indicates that you will be paid gross annual salary of £30,000. Appendix J of the Immigration Rules indicates that the appropriate salary for your job type, detailed as code 2135 on your COS, should be at a minimum of £33,000 for an experienced worker and £25,800 for a new entrant. The rates stated are per year and code is based on a 39-hour week as the source is the Annual Survey of Hours and Earnings 2013. Your COS states that you will be working a 37.5-hour week which means that your salary (pro-rata) is £31,200 and therefore below the minimum salary for an experienced worker.

are u of 26 years of age or older? or were u assigned a cos for more than 3 years?
in either case, i think the refusal is legit and there is no benefit of applying for a review. U are better off asking your employer to increase the salary and apply again.

Thanks for your reply.

I am 32 years old and CoS is assigned to me for 3 Years only. Could you please help if my employer was having only last CoS available, which I have wasted now. How can they arrange new for me to reapply. Is there any per year quota / limit for employers set by UKBA to assign new restricted CoS.

since u are applying from outside uk, they need to apply for restricted cos. There is a quota for it and they have to apply by a certain date of every month.
in reality its not your fault.. its their fault that they did not assign you the salary of experienced worker. They should apply for a new cos, and put appropriate salary and then u should apply again.
there is no other way around it.
