tier 2 company merging

Post by jprakrn » Tue Jul 07, 2015 3:04 pm

Hi all,

The company I work say "Hello Ltd" - London (having Tier-2 sponsor licence and sponsored me for tier-2 general visa), merged with another company say "World Ltd" - Bristol, together formed a joint venture of "Hello World Ltd".

the new company is called as "Hello World Ltd" and London site is treated as headquarters.

"Do the new company ("Hello World Ltd") need to get new Licence to continue sponsoring me ? ... "

(OR)

Can it be treated just as - change of business name?

Note: (The other company "World Ltd" do not have sponsor licence and no migrants are working).

You will come under TUPE and don't need to make a separate application.
your current employer (Hello Ltd) should inform HO about this merge asap, otherwise HO will take action (might curtail your leave) and
your new employer(World Ltd) should apply for sponsorship license (if they don't have) within 20 days of merge.
Please refer to section 13 of below Tier 2 Guidelines.
