refusal leave to remain

Hello All ,

I need some information on application which i made in September 2014 ILR , I am a British citizen which has been in the uk from birth.

I got married in April 2014 , and submitted application in September 2014 it was a long wait and after a few emails to HO we got a outcome in June 2015 - REFUSED under human rights. I am not sure why have they application under human rights .

immigration history of my husband :
10 march 2010 entered the uk as tier 4 general student from feb 2010 till sep 2012
13 sep 2012 submitted application leave to remain in the united kingdom as tier 1 entrepreneur which we asked to vary to FLR(M)
17 april 2014 we got married
18 sep 2014 we submitted an application for leave to remain in the uk (m)

the objection they have use have said my husband has used deception on previous application , we have got the right to appeal which we have done .

today in the post we have got is96 which says he can't work ect .

Has he used deception in a previous application?

no he hasn't . all the information which has been give are 100 percent true , they are saying that the english test wasn't taken by him and this has be obtain without him ,

He has also taken another test which we used in our application leave to remain

has anyone won a case in the court in regards to this matter ?

I believe under the current rules, he should be allow to take another test if there is a doubt as to the authenticity of the last test.

But a new test was done, it is unclear why they refused. Under what paragraph.

Is there any children in your relationship, and was there any question as to the genuine nature of your relationship.

hi ,

we have been together now for more then 2years , we have joint bills ect , HO didn't have issues on a relationship , we don't have any children at the moment , also I'm working full time .

refusal paragraph under private life paragraph 276ce with ref 276ade(1)(iii)and (iv)of the immigration rule .

Husband has been in today and they have asked him to come
Back every 2weeks. Which I thinks is really sad ,

The staff at the immigration office are so rude and they think
Like they own the place . Treat you like you have done something wrong ,

My question is they have said no work ect is there any
Way around this , HELP plz
