varying Tier 1 enterprenuer to spouse visa

I applied for tier 1 enterprenuer (with a partner) & got rejected but we appealed against HO Decision and FTT ALLOWED our appeal and didnt heard anything after. I got married 8 months ago and have got all the documents ready to apply for spouse visa ( payslips to meet financial requirements) . I have been told by my solicitor to wait until HO approve business visa and then apply for spouse visa through one day service with in 28 days of getting business visa. Is that possible to apply for spouse visa like that ( showing payslips which i got during 3c & 3d leave during appeal ) as I wont be able to work after I got business visa??
