Visit Visa Refused

My sister's visit visa was refused due to following reasons. She applied with her two kids who were coming to the UK for 2-3 weeks during summer holidays.

Her Husband already has a Business Visitor visa for couple of years and he visited to the UK twice in the last 12 months and both visits lasts for a maximum of two weeks. (It was genuienly exhibition related).


The extract of of the refusal are given below
.

I have refused your application for a visit visa becuase i am not satisfied that you meet the requirements of paragraph V4.2- 4.10 of appendix V of immigration rules.

In order to Assess your intentions, i must consider your circumstances in your country based on the information you have provided with your application. All applicants are advised to provide documents to substaniate their circumstances. We expect applicants to provide this infomraiton as it assists us in making an informed assesment as to whether they intend to comply with the terms of visitors entry clearance.

I have considered that your spouse has a valid UK visa issued to him last year for travel for business purposes. At that timeof his visa issue we had considered that he was running a business in your country with the Name XYZ Limited and that he had significant ties to his home country and the documents provided now shows that this business still exists; however i note that when he last applied he declared an income equavalent to (£1240) per month, yet his ban statement shows credits far in axcess of this declared income. Signifantly in June 2015 i.e. £12000, which is over 9 times his stated income deposited in just less than 2 months.. The origion of these funds are unclear and given that they are inconsistent with his circumstances in Pakistan. On the basis of limited information about your circumstances i am not satisfied that you are living in settled circumstances in your country. i am not therefore statisfied that you are genuienly seeking entry as a visitor and that you intend to leave the UK at the end of your visit V4.2 (a,c)


Now her husband's income through his business is lot more (But it is a shared business with his brothers) he only moves eqavalent to £1240 a month in his home country, and that is what was shown in the application,,, however he did had two large receipts in the last two months.
(1) was regarding a sale of his private car and the
(2) was the repayment of a loan which he gave to someone a while ago..

As he was planning travel to US at the end of the Month for couple of weeks, he initially had a plan to come through UK along with the kids and then he would fly to the US and the kids will fly backhome, so he asked someone to return the money which he deposited... However, these payments have caused the above issue..

Since the rules were changed, there is no administrative review, nor there is any right of appeal given to them...

I have two questions now.

1- Is it going to cause any issue to his own Business Visitor visa ? if he travels to the UK, do you think he would have any problem ?
2- I have asked him to simply put whatever it is in a cover letter and submit a fresh application, as more importantly , his own travel right could be effected with this...

Can i ask you guys to give us your input regarding this please ?

Too be honest, i am a bit of annoyed, why the hell a case worker just not pick up the phone and ask the applicant to clarify it, why the evidential flexibility is not applied where they are not sure about things.. The judgement level of these guys seems like they dont give a monkey if someone hasnt explained things little as that.

Maybe you shoukd have explained this on the ' further information' when you applied. You should reapply, explain and provide proof where neccessary
