Tier 2 ICT - Came UK after Apr 06 2010 - ILR Possible ?

Can anyone tell me please,
1. As I came in after 16th April 2010 on TIER 2 (ICT) so is there any chance I can get or apply for ILR (Completed 5+ years in UK) ?

Page 32-33 says below

245GF. Requirements for indefinite leave to remain
(d) The continuous period of 5 years referred to in paragraph (c) must include a period of leave as:

(i) a Tier 2 (Intra-Company Transfer) Migrant granted under the Rules in place before 6 April 2010, or

(ii) a Qualifying Work Permit Holder, provided that the work permit was granted becausethe applicant was the subject of an Intra-Company Transfer.

Your visa is not a work permit but a T2 ICT issued after Apr-2010. Unfortunately, you may not be able to apply for ILR.

Just curious - What was was visa applied? was it before 06-Apr or after 06-Apr? If it is before 06-Apr, then you may be eligible. For application outside UK, generally the date of payment is considered the date of application.

The OP was given the answer to this query in February 2015!

If you applied before 6th of April 2010 for entry clearance, then you are eligible for ILR. Make sure you meet the other requirements too before you apply. Generally the date of application is the date the payment is taken (from outside the UK).

Your arrival date in the UK has nothing to do with whether you are eligible for settlement. The date of application has everything to do with it. So find that out from your / your employer records ! Or make subject access request and see if UKV&I has that information.

Can you pls help me "subject access request" what to write in order to get my date of application or fees paid to UK Home office in Bangalore in year 2010

As I got my visa stamped as "EARLIER VISA[/TIER 2 (ICT) ESTABLISHED STAFF VALID FROM : 16 APR 2010"

So I think i must have filed my application before 10th April 2010.

Highly likely, but you need to be 100% sure!

There's an option " Visa Application Forms (out of country applications)" under Part A: Records requested (page 3 of the form).
Tick that.

Or, tick all under Part A. I don't see anything written to suggest that you cannot tick all the options. So you will get copy of every information that they hold about you.
