NON EEA NATIONAL PARTNER TO VISIT UK

Hi everyone,


Colombian holding spanish passport living in UK has her daughter living in Spain. The daughter with spanish passport want to come to visit her with his boyfriend an Non EEA National (he has the spanish passport residence but not the spanish passport). Has he to apply for a visa to visit or according with european case law could come without it? in that case, must to show any documentation at the UK border?

Well as he's 'only' a boyfriend at the moment, he can't derive any rights from the EEA citizen, so he'll have to apply on his own merits as if he was alone.

From my understanding partners, where there is no civil partnership, who can show that they are in a ‘durable relationship’ are also considered to be extended family members of EEA nationals but i need to confirm according to what. Dont you think the same?

Yes but that means in UK eyes two years of provable cohabitation, as man and wife - do they have that? There is no set down test for a durable relationship under EEA rules, so the UK is free to use it's own take, as above.
