UK Citizen Marrying an Overstayer with child! PLEASE HELP!

Post by JONSDA » Mon Jul 20, 2015 8:29 am

Hi, all I would like some information from anyone who knows a lot about this.

I, as a UK Citizen, have known my girlfriend for over 8 years who is an overstayer. We are currently courting (in a relationship) right now and we are progressing to marry. She currently has a child, who isn't mine, but I'm already like a Father to her. Hopefully, when we marry, I will adopt the child. We want to get married in a registrar but want to know if there are any legal matters we must consider.

Are there any issues, for example, her having to go back Home in the West Indies through deportation, any issues whatsoever. What proof do we need to show that our relationship is genuine? I have multiple evidence such as marriage counselling we have received, countless messages between myself and her and messages between my friends and family regarding the progress of our relationship and intent of marriage. And the fact that I want to adopt her child should be evidence enough, but I want to make sure everything is right in the eyes of the law. My opinion on what's genuine doesn't matter.

Can someone provide their expertise, any links to websites for more information? I really want to make sure there are no barriers because we really want to be married soon. I will also have the ability to provide for them both sorely from my income alone.

Thank you for reading and I look forward to what information you all have for this situation!

My situation is not really like yours. My case was just routine: ordinary BC meets & wants to marry non-EEA citizen.
We did it in the end and my wife is now naturalised.
However it has been a world of pain, stress, confusion and expense dealing with the UKBA/HO and wrestling with immigration law over the past 6 years.

You may expect the same as you are entering into a more complex area of immigration & family law.

In you case have you been to the registrar to discuss legal basis & permissions for arranging a marriage?
See here: http://www.immigrationboards.com/eea-ro ... 65661.html

& this case may help too:

I suggest you need to hope for the best but plan for the worst.
Best of luck.
