Status during JR

Hi Seniors,

I am asking this question on my friends behalf and for Clarification.

His ILR was rejected due to some odd reason and now he has applied JR.
Passport is in custody of HO and he regularly go for attendance.

His Landlord has now kicked him out due to his visa status.
He informed HO about this situation and told them he can't move to any other property as he dont have the passport, the response from HO was we cant help.

So the questions are:

1. Can he live with his friend , Keeping in mind that HO is aware with new address.
2. Will it be an issue for his friend ?
3. While the JR is filed and waiting for hearing what is his status (Illegal or legal)

Please advise.

AIUI, a request for JR has no bearing on the "overstay" of the person in question unless a judicial review concludes that the decision by the immigration authority was not in accordance with law and is annulled.
Section 3C leave ceases when appeal rights are exhausted.

That said, I might be wrong ....

Did he apply for ILR in-time?

Thanks for your response, my friend has applied the ILR just on the day and his hard luck the payment did not went through he then received all docs back with in 7 days.

What he did he applied again after passing the 28 days and got rejected.
He is been given a chance to appeal outside of country but he did file a JR from UK.
Now he's been out of job and and out of flat as well.

So the questions are:

According to Sushdmenta, for point 3: he is a over stayer but will it effect his friend who is trying to help him to give place to sleep in night

Hi Sush,

Many thanks for the response, so regardless of JR, until he got his decision he will be counted as an Overstayer ?
So will it be an issue for friend to give him place to sleep, keeping that in mind that HO is been informed he is staying with his friend and will continue to report.

Please advise.
