Tier 2 - RCOS, Switching and Making Application

Post by varunsg » Thu Jul 23, 2015 4:03 pm

Hi Guys,
I am a post graduate student on Tier 4 (General) visa, graduating in this September and has valid visa till Jan 2016. My wife is on Tier 4 Dependent and already working for a A rated Tier 2 sponsor company from past 8 months. Her company has carried out RLMT and requested UKVI for sponsorship. This should come up in August cycle meeting and will be approved hopefully . I have following queries in mind for which I got different answers so far from friends and colleagues, can somebody help me,

1. Can she make application for Tier 2 (General) with RCOS inside UK or need to go back home country ?
2. Can I make my application along with her inside UK or need to go back home country for Tier 2 (General) dependent ?
3. After obtaining RCOS from company, in how many days, do we need to make application to UKVI ?
4. Does she need to take up IELTS or equivalent for english language requirement ? (She has 4 years Bachelors engineering degree, not from UK)

Thanks,
Varun

Hi Varun,

Looks like I will be in the same situation in near future. Do you know whether your partner could continue working after making the application for Tier 2 visa or she will give a break during the application process?

For tier 2 extensions, it says the applicant can continue working until a decision is made. However, there is no information regarding Tier 4 Dependants.

Thanks

1. She may apply for leave to remain (245HD(b)(14)).
2. You may also apply for leave to remain provided you are not in the UK as a short-term student (319C(h)).
3. Read the Tier 2 policy guidance.
4. As above.
Life isn't fair, but you can be!
