Query related to Indefinite Leave to Remain in the UK.

Hello All,

Currently I am working in the UK on a work permit. Can you please let me know when to apply for Indefinite Leave to Remain in the UK? Do I need to complete full 5 years of stay in the UK on a work permit and then only I am eligible to apply?

Prasad, you are right it is five years on your work permit + English test and then you can apply for ILR.

Earliest you can apply is after 4 years and 11 months

Thank you for the response.

To be specific, I came to the UK in March 2003, can you please let me know when I can start the ILR process? Can I start it now, or do I need to wait till Feb 2008?

You can't apply until Feb. But don't forget you need to take (and pass!) the Life in the UK test.

My current work permit is expiring at the end of November 2007. So it is very likely that I won’t be having a work permit till Feb 2008, so am I eligible to apply for the ILR in Feb 2008?

Presumably your leave expires at the same time?

If so, after that expiry you will be an overstayer.

After Nov 2007 I will be going out of the UK as I will not be having a valid visa to stay here. Can I then apply in Feb 2008 from outside the UK for the ILR? I understand that out of 5 years one can be out of the UK for about 10 months and even then application can be made for the ILR. If so is that applicable for my case? Can you please let me know.

This is not going to work! Whilst you are not tied to the UK for the whole of the 5 years, it is necessary to have valid visas for that period. Not having any UK visa at all for the last 3 or 4 months is going to stop you getting your ILR.

Seriously consider asking your employer to apply for an extension to your WP, following which you can get a visa extension.

Actually I got my work permit issued on 14 Feb 2003 and I have a valid work permit till 22 Nov 2007. Now where do I stand for the ILR?

In my opinion you don't stand for ILR. You need to get an extension to the WP.
