Can EEA Permanent Residence Card be used after UK Passport?

Post by samiuk » Fri Jul 24, 2015 5:20 am

Hi,
I would like to get some help regarding my situation. Let me write my situation first for your better understanding;
I was married to EEA national spouse and got divorce after 4 years 5 months of marriage while i had EEA residence card. Got my retention of rights and then 10 years permanent residence card. On the basis of which i got british citizenship after waiting over 1 year. Currently i'm British Citizen for last 3 years and decided to get marry again. I still have permanent residence stamp on my Pakistani passport and British passport. my question is;

Can i apply to sponsor my future wife using EEA permanent Residence card (still vaild for 6 years) on my pakistani passport? as UKVI requires £600 Health surcharge for initially 2.5 years family settlement visa + £956 visa fee for non eea spouse of British Citizen and further changes on extension of visa in future plus another Health surcharge payment. On the other hand Non EEA spouse of EEA national doesn't require health surcharge and visa application fee costs only £55.

Thank you for reading it so far. Any suggestions would highly be appreciated.

No, you can't, as that has been superseded by your British citizenship. Even if you were a full EEA citizen and also got British citizenship, you would be treated as a solely British citizen for immigration purposes.

To apply via the EEA route, you will need to apply via the Surinder Singh route (move the centre of your life i.e. your work, bank accounts, etc) to another EEA country for at least 3-6 months, maybe longer, get your spouse to come there and then reenter the UK together.
