SET(M) Question

I'm a UK citizen and my wife is due to submit her SET(M) in April next year - one of the questions on it is, 'Is You Partner Working in the UK?' Due to recently starting a new contract in Russia I'm now out of the UK seven weeks out of every ten, and therefore outside the UK tax system - will this have any effect on her application if the answer to this question is 'No' ?

The main problem is going to be proving that you are still resident in the UK. Is this a temporary contract, or permanent?

It's probably until the end of 2008, but it doesn't state any specific period in my contract, just until the job end, which is basically a flexible date.

Can anyone offer a definitive answer to this or know where I can get one; I wouldn't mind paying for an answer if necessary, but don't know who can help?

It's obviously really important, as apart from the fact she might not get her ILR it's also going to be £750 down the tubes if they refuse it on the grounds of myself not being employed in the UK.

I wouldn't consider myself not resident in the UK as I spend my three weeks off there, but I'm not sure of the legal definition of resident?

It's pretty ironic that myself working overseas was how I met her, and now it could also be the thing that puts a spanner in the works... mad really...

I'm afraid only the HO can give you a definitive answer - it's a matter of finding on the facts where you reside.

I think it will be very important to make your application as strong as possible to show you residence, including your home in the UK (owned or rented) your family ties, where you live when abroad, etc.
