30 Day Vignette and BRP

Post by DuncLua » Wed Jul 29, 2015 11:05 am

Hi All,

I have a some concerns regarding this new ruling for settlement/spouse visas that I have just now noticed regarding the 30 day entry vignette and collection of the BRP. I hope that someone can help me please regarding this matter.

My wife (an Angolan national) submitted her UK Spouse Settlement visa application on the 15th June 2015. At the time I was based in Angola (previously living as a resident for 3 1/2 years) on a working assignment but had to leave on the 27th June to attend a training course in the UK. I have been stuck in the UK since due to my Angolan Working Visa expiring, with my wife and 2 young children stuck in Angola waiting on her Visa decision.
Before making the online application I checked on the internet the expected processing timeline for Angola and it indicated around 30 days. I also spoke to a British member of the British Consulate in Angola for confirmation who informed me to my face that with the correct documents it would just take 15 days. I questioned this but he was adamant that was the current timing for a settlement visa. With that in mind I marked down the expected travel date as being the 27th June in hope that my wife and children would be able to travel with me when I departed Angola (we did the online application on the 25th May but the earliest visa appointment turned out to be the 15th June).
We were quite surprised when my wife submitted her visa application and was then informed that it could take 3-4 months, completely different to what I had previously been informed.

My concern now though is this new ruling regarding the 30 day vignette for travel which I have read is valid from THE EXPECTED TRAVEL DATE MARKED ON THE VISA APPLICATION FORM. Given we put down 27th June I am now worried that after going through all this, if my wife does actually receive her visa/vignette it will not even be valid for travel as soon as she receives it.
That would mean having to apply for another 30 day visa to enter the UK, however I cannot find any information on the type of visa that should be applied for in this case? Does anyone have any information regarding this type of visa and how long it would take to process? I am also assuming that this would also result in the BRP issued for collection no longer being valid and possibly cancelled if not collected in time?

I really am worried now, what with having 2 young children, the youngest being only 3 months old, and the fact that I am currently unable to get back to Angola to assist my wife with this as I have been the once who has dealt with all the visa (visitor) applications over the last few years.

As ever, any help or advice is welcome.

If you had put an "intended date of travel" that has already passed, the "Effective from" date on the 30 day visa should be the day the visa is issued (if not date in the near future ).

No concept of issuing of back-dated visas.

Hi sushdmehta,

Thank you for the prompt reply and info, much appreciated.

Yes, that does make sense. I was perhaps engaging fingers and hitting the panic button before giving it a bit of common sense thinking. We've just been through so much recently to try and get this visa that it seemed one obstacle after another to get past and when I read that new ruling it just seemed to be the next problem we'd have to deal with.

Thank you.
