T2 General outside UK - Same company

Hi.

I am new to this forum and will really appreciate guidance with regards to my query.
I am working for UAE office of my organisation from past 8 years. The management has decided to promote me to a managerial position (I am currently a consultant and will become consulting manager) and planning to permanently relocate me to its UK Office. This seems like a T2 intra company transfer case but I am keen to apply for ILR in future therefore I am seeking a possibility to apply under T2 General category instead. My questions are:

1. Is this going to be an issue if i apply under T2 General instead of T2 ICT - as my past experience is with the same company ?

2. Will the company need to do RLMT in such case?

Any additional advices you would like to give me ?

Guidance from experienced members will be highly appreciated.

1. You must apply ICT when you still working for same company. Tier 2 general will be complex in your case to prove a genuine vacancy and RLMT is not tailored.

2. RLMT required for Tier 2 general but not for ICT.

Thanks for the reply shah. What if my salary is £155,300 or higher. That will make me exempt from RLMT. Would it then be possible to apply for T2 General ?

RMLT does not require for you if you are applying Tier 2 General with that salary. However, I think you still need to apply ICT unless if there is a gap in your employment with the current company. What type of Tier 2 licence does your company hold?

It has got T2 License with A Rating both for General and ICT.

There should be no problem for you to apply directly for a Tier 2 General. As you intend on staying in UK permanently, there is no point of going down the ICT route first.

This is not true. If the company outside UK is a seperate legal entity they can apply for Tier 2 General.
Highly likely that they do not need to go under Tier 2 ICT since the UAE company would be registered as a separate company in the Ministry of Chamber and Commerce there.
