Tier 2 visa with dependants

Dear experts/seniors,

kindly help

I'm under the same problem with my family.

my son 14 yrs old now is studying in india in a boarding school and will be studying there for next 3 years. i am about to apply for Tier 2 visa for myself( shortage occupation ).

my queries

1- should i apply him a dependent visa now for 5 years? ( he will only be in UK every 4 months for 2 weeks. so in a year he will be outside UK more than 9 months for the next 3 years )

2- if i dont apply him a dependent visa now what impact will it have? ( as i may get him a tourist visa every year and not spend too much money on his tier 2 dependent visa )

it all depends on what your long term plans are and what your plans are for your kid as well. If you want, and if the rules after 5 years allow you to settle here, and you want your kid to come in uk to study as well later in his life, then it may be advisable to apply for his visa now with yourself and his counter for his own ilr can begin now. Please note that his age is such that, if you do manage to get ilr in few years time, he will be over 18 and may not be eligible for ilr as your dependent as he will be over 18, unless he has been your dependent since he was under 18 and will have to complete his own time duration to be eligible for ilr.

Thank you very much sir!! really appreciate. so i will take your advise and apply for his visa with me so that his ILR clock starts ticking from now. But if i do that

is it mandatory for him to travel with me to uk end of this month?

if he doesnt come with me end of this month due to his school work, can he travel to UK by himself in Dec 2015 during his school holidays ? will he face any issues travelling without me ( as i am the main applicant and he is my dependent )

finally- can he be outside UK more than 9 months per year for the next 2 yrs due to his schooling in India

I am not from an English speaking country

As proof to gain 10 points for English language, I have the following

1- Original degree certificate
2- letter from university ( outside UK ) confirming the degree was taught in english
3- I also have the PBS where i claimed 10 points putting my course details.

is this enough or do i need to get a letter from UKNARIC

another problem is the letter from university has my maiden name before marriage. now as per my passport my last name has changed after marriage, is that a problem. ( i can always give my old passport which has my old name which matches with the letter received from the university today )

please can someone help me with my queries

The clock starts from the date of issue of visa as long as u enter the uk within 90 days. if the entry to uk is outside 90 days then the clock starts from the day he first arrives to the uk.
There is however something else that you should take note and inquire/read more about. with the new rules, once your visa is granted, u will be given a visa for 30 days to enter uk. once u arrive in uk, u can collect you visa card (known as BRP) from post office.. i am not sure if that will create a problem for him as you want him to come in December.. better check this..
also if u decide to apply his visa separately, u might have to show maintenance fund (£630) for him held for 3 months in terms of a bank statement. If your company has sponsored to take charge of the maintenance for you, then u dont need to show the money if you all apply together.

there should be no problem in him travelling alone.. but make sure he carries a letter from parent guardian saying that he will be travelling alone/or with someone, if he will be travelling with someone else.

after your advise, i have decided to apply his visa aswell with me.

i will bring him to uk with me and then send him back in 1-2 weeks after getting his BRP.

glad to know there wont be any problem if he stays outside UK for 9 months in a year.

also i understand its best to apply for him now so that his clock will start for ILR now rather than waiting so that even if he gets to 18 yrs he will be safe
