Further Leave To Remain questions

Post by Ruggles » Mon Oct 29, 2007 1:20 pm

Hello. I would be extremely thankful if someone could help me with this question. I have searched the forum to the best of my ability but, alas, have been unable to find anything helpful as yet.

My wife entered the country on a fiancee visa six weeks ago and we are just now married. I will shortly begin phd studies in london and so do not at present have a contract income. I do temp work (full-time 7 days a week) at the local library, with an income of around £800 per month after tax.

1 - We have been living with my parents while we wait for her to get permission to work. She has a degree in computer science from a top american university. In regrads to applying for her further leave to remain, is it possible for my father (income £50,000) to say that he is happy for us to live with him until my fiancee is granted FLTR and is then able to work? If not, is there anything I can do as we would be trapped in a circle whereby we can't get our own income until she gets a job and she can't get a job until we get FLTR. Do we absolutely have to move out of my parent's house before we can make the application?

Futher info: I have £10,000 in savings (from time spent working) which I will use to rent accomodation in London while I study.

Once again, thank you kindly for any help you are able to give. I sincerely appreciate the time that the moderators and others spend on these forums.

Your father can say this.

I doubt you will have any problems.

See also Chapter 9 The maintenance and accommodation requirements
If the accommodation is not owned by the couple (or one of them), the Rules require that there be adequate accommodation which is for their exclusive use. This need not be as elaborate as a self-contained flat. It is acceptable for a couple to live in an existing household, e.g. that of a parent, uncle, aunt, sibling or friend, as long as they have at least a bedroom for their exclusive use.
As Victoria said, you should be fine.

As you can show that once your wife gets leave she can work (evidence of degree etc will be useful here) and that you have savings to tide you over until then, you should be fine.
I am not, and cannot, offer legal advice to particular people. I can only discuss general areas of immigration law.

People should always consider obtaining professional advice about their own particular circumstances.
