Immigration issue - need advice

Post by ali_shaikh22 » Sat Aug 08, 2015 12:04 pm

Hello

First of all please accept my apologies if I am posting this in the incorrect section. I'm not exactly sure where it would go.

My story starts like this:

My wife is one of two daughters, both live in the UK for approximately 10 years. Their mother, my mother-in-law, has always lived in India.

My father-in-law passed away approx 30 years ago and since then my mother in law was taken in by her sister and husband (who is my father-in-laws brother),my wife and her sister also grew up in the same household and were all treated equally

Around 2010 My mother-in-law's sisters husband passed.

Since the passing there has been much tension in the house with arguments and abuse taking place towards my mother in law who is now 62 years of age.

This year (2015) my sister in law got pregnant and we managed to call my mother-in-law over for the birth of her grandchild.

During her stay in the UK, the family in India have turned around and said that when she goes back to India, she will have no home to come back to.

As you can imagine, we are all very concerned about what will happen to my mother-in-law upon her return to India in September 2015.

Currently she has arrived in the UK on a visit visa of 6 months, however due to the dire circumstances brewing in India awaiting her return, we fear she will be homeless and will end up receiving abuse and persecution at the hands of her sister, sons and daughters.

We would like to know if there is a possibility of keeping her in the UK. Both my wife and I work full time and would be able to look after her and ensure her basic needs i.e roof over head, and food are met.

Any advice would be much appreciated

Reading adult dependent visa for mother in law should give you an idea.
Appendix FM wrote:E-ECDR.2.4. The applicant or, if the applicant and their partner are the sponsor's parents or grandparents, the applicant's partner, must as a result of age, illness or disability require long term personal care to perform everyday tasks.

E-ECDR.2.5. The applicant or, if the applicant and their partner are the sponsor's parents or grandparents, the applicant's partner, must be unable, even with the practical and financial help of the sponsor, to obtain the required level of care in the country where they are living, because -
(a) it is not available and there is no person in that country who can reasonably provide it;
or
(b) it is not affordable.
Why can't the immediate family help her buy/rent a home in India and a hire a domestic worker to help her?
Life isn't fair, but you can be!

Also you need to bear in mind that an application for a dependent visa can't be submitted in the UK while on a visitor visa apart from the most extreme compassionate circumstances. If the applicant is critically ill for example.
If a dependent visa is refused, the door for future visitor visas is likely to be closed.
I understand that official figures show that there have only been 34 successful applications for this category since the rules were tightened in 2012, and a percentage of these were allowed only after a lengthy court appeal.
sushdmehta has given you good advice.
