Dependant visa

Post by Bluesky88 » Mon Aug 10, 2015 12:38 pm

Hi all, I am in a similar situation i.e. my husband is switching his job this month and our current visa is valid until March 2016. But the thing is that me and my daughter are living in Karachi (looking after my mother-in-law here). Do any of you think that if I apply for mine and my daughter's visa from Karachi after my husband is granted his visa, there won't be any objection of subsisting marriage? Because I have only lived with my husband in UK for 2 weeks ever since I was granted visa and had to return to look after my ailing mother-in-law. Or should I apply for dependent visa from UK only? Please advise. Thanks.

I think that you should extend from within the UK before your leave expires. It's unclear if applying for entry clearance breaks continuous leave.

Include evidence of subsisting marriage.

Thanks Vinny, I thought the same too that I should apply from UK but my husband is not convinced and is saying i apply from Karachi only...He was granted Tier 2 visa from Apr 2013 till Mar 2016 and now he is switching jobs...If I have to apply from Karachi only for extension, then subsisting marriage evidence should be on top priority right?

Yes. However, be aware that if your continuous leave is broken by the entry clearance application, then your qualifying period for ILR will be reset to another 5 years.
