Query

Post by RAJ2007 » Mon Oct 29, 2007 2:12 pm

I have got a query. Please help.

My appeal (in country, student extension) was allowed about two weeks ago (from the date of receiving the determination). I am now waiting for HO to contact me asking for my passport.

1. How long should I wait before I chase POU or HO? Do I ask my MP to chase up the matter ?

2. Could HO ask for a review at a later date? Please note: It's already more than two weeks from the date of deemed receipt of determination.

You shoul call the AIT on 0845 6000 877 and ask them whether or not the HO have asked for reconsideration. If not then you could write to the HO Appeals Implementation Unit, P O Box 502 Leeds, LS1 2ZE or email them: determinations.team@ind.homeoffice.gsi.gov.uk and ask them what the heck they're waiting for?!

Thanks for your reply.

1. Is there any time period I should wait before I chase HO?

2. My determination says ' visa extension not beyond 2008'. Does that mean HO will stamp until Dec 2008 or do they use their own discretion?

It depends on the facts of the case. You said it's a student extension - when is the course finishing? If it goes beyond 2008, you may get it until Dec 2008. If the course finishes before that, it's most unlikely.
I am not, and cannot, offer legal advice to particular people. I can only discuss general areas of immigration law.

People should always consider obtaining professional advice about their own particular circumstances.
