It would be very helpful if anyone could guide me about a problem I am facing right now.
I was granted a COS in August based on an SOC 2211 job. My job offer letter stated that my gross salary would be £45003 comprised of basic salary £30002 and £15001 guaranteed bonuses and allowances. when my Rcos was granted I realised that the salary mentioned in the certificate was £59539 with the basic salary being £39693 and guaranteed bonuses of £19846.
I confronted my HR department about this and they confirmed that it had been a mistake on their part while submitting the RCOS and that they have now rectified it by adding a sponser note stating that my salary is the former £45003 rather than the latter £59539.
My query is that If I submit my visa application on the basis of this RCOS, is it going to have an adverse effect on the decision.
A general overview of the rules made me realise that the employer can lower the salary via a sponsor note as long as it resides within the range specified in the advertisement, this job's salary range is £30002-39693, so I am in the clear regarding this rule.
But then their is this other rule stating that the salary can be lowered only if both the salaries,( the one in the certificate and the other in the sponser note), scores the same points from the COS point scoring table. Which is not the case with me as £59539 would get 20 points and £45003 would get 15points.
My question is if anyone could please guide me if It would be a wise decision to apply for a Tier2 visa based on this RCOS. I looked through the webpage to see if someone else had the same problem, but apparently I couldnt find any threads indicating a similar query.
