EU Citizen with non-EU wife

Post by hoopz » Tue Aug 18, 2015 8:35 pm

Hey guys! Hope you are all well.

My wife and I currently live in the US. I'm an EU citizen (UK), she's Canadian. We are considering temporarily moving to Europe to work and live closer to family. Germany is our 1st choice since my wife's sister lives there. We are thinking of staying either 3 months, 6 months or 1 year, but no more than 1 year.

According to the research I've done, living and working there shouldn't be a problem for me. And according to the EU laws, my wife should be allowed the same rights as me when we enter the country. But this is where it gets a little fuzzy for me.

Does that mean my wife can start looking for work in Germany immediately? I couldn't find a solid answer anywhere. I hope you guys can help.

Thanks in advance!

Germany is easy for a canadian passport holder.
She will get 90 days for every visit.
If she want to work the procedure is
- registring the residential address for both at the town hall or a sub office
- applying for a Aufenthaltskarte-EU as a family member of a EU-citizen at the Foreigners Registration Office (Ausländerbehörde)

If she hold a receipt for the application in her hands she can start working and don't have to care about the 90 days anymore.
Theoretically she could work without anything as a family member EU but no employer let her start working without official proof.
If she want to start a application for employment from the states she should point out that she is a family member of a EU citizen and both are moving to Germany.

PS: You have to prove to exercise treaty rights as a EU citizen for a stay longer 90 days to support the application for your wife at the Ausländerbehörde.
