Summary of Deception Cases!!!

Post by HarryJones » Fri Aug 21, 2015 1:12 am

Gurus,
I have read many posts.
In a nutshell, on what conditions can the previous case of deception be removed in further applications (extension, ILR or naturalisation)?
Waiting to hear your valuable responses.
Cheers

There are rules stipulating that if deception is used, ILR, citizenship etc... can be revoked. I wouldn't have thought there is a time limit... Basically, if deception precipitates a grant of leave that would not have been granted, the results of the deception continue.

thanks.
1. Does it mean that ILR & citizenship can be revoked from people if deception is now discovered.
2. If there was doscovered an initial tax mistakes (between HO and HMRC) by HO. And taxes later paid, HMRC records corrected and amended. Can the the deception clause be removed and required VISA granted.

1.) Yes.

2.) 'Tax mistakes' aren't the same as deception. Deception shows intent, like providing fraudulent documents or deliberately concealing facts, like a marriage, child, dodgy immigration issue... etc...

Is there something specific you are worried about?

Thanks.
I am just curious, how will HO now discover people already with ILR & citizenship with previous deception issues.

These things have a way of unraveling...

There was a case here the other day of a guy who married an EU citizen and gained BC, who now wanted to bring his first wife (ie was married before and during the marriage to the EU citizen) and child (born during the second marriage) to the UK!!!

Clearly, his second marriage might have been a marriage of convenience (or not), but would have been null and void beause of his first marriage...

I do reckon some people get away with it - but I hope their attitude to obeying the laws of the land ends with immigration deception.
