Tier 2 Queries

Hi all,

Quick question members:

The company I work for has sponsored me a Tier 2 General Visa which got extended couple of months ago, however the management is planning to liquidate the company which sponsors me and holds the sponsor license and operate through our sister company (holding company)/ form a new company (none of them holds a sponsor license until now). My company still wants to carry on with my employment under the same job title and salary in the new establishment. Based on these could you please suggest what options are applicable in my case:

1: The existing sister company which is basically a holding company of the current company I work for applies for a sponsor license?
2: The new company when formed applies for a sponsor license?
3:Will a RLMT be needed by both the companies or they can assign me an unrestricted COS bearing the fact that my salary is below £70k per anum?
4: Anything else if applicable in my case

If the company is being liquidated, it doesn't sound like TUPE would apply.
1.) Whichever company which continues to exist (comes into existence?) and will direct your activities should apply for a license.
2.) Whoever will employ you.
3.) Yes, RLMT needed unless your salary is £150K+. Provided you pass the RLMT, then can issue an unrestricted Cos.
4.) It is essentially a standard change of employment application.

Will it effect the 5 year ILR route as I have already completed 3 year's of service at the same job if I work under the new company but within the existing job title and same salary?

Provided you meet the other requirements for ILR at the time of your application, changing jobs should have no effect, provided you are not unemployed for more than 60 days and you do not overstay any visa by more than 28 days. There are so many caveats when applying for visas; basically, no there will be no real effect by changing employers...
