CRITICAL SITUATION – JOB OFFER WITH IGS BUT FOR VISA EXPIR

Post by Obalende » Fri Nov 02, 2007 7:45 pm

Hello everyone,

I need advise concerning the following situation and please do spare a couple of seconds to give your thoughts.

CASE DATA
GRADUATED FROM UNIVERSITY on 17/07/2007 with Student Visa (from 2004 extended to 16/12/2005 – 31/10/2007) – i.e. I had about 3 months free leave after my graduation.
CITIZENSHIP – NON-EEA

I then applied for International Graduates Scheme (IGS) – and was stamped (08/07/2007 – 05/10/2008).

Fortunately, I have found an Student Industrial Placement position designed for either penultimate year students (2nd years going to final year) or students who have graduated but intending to do a Masters course. This position is supposed to be a 12months position (but they may reduce it because I showed the Company staff my IGS visa with the 05/10/2008 expiry and told them that I am able to renew it to start my Masters again as a student). I got the offer by phone today and the contract should arrive at my house tomorrow. I will be expected to start around 23rd November 2007.

If the contract should come to me tomorrow and states that my job will cease on the 1st October 2008 (slightly less than 12 months as the Company sees fit), then no problems; but if it states that something like 23st Nov 2008 (making it 12 complete months), then I am a little scared!

1.If I am emplyed now with my current visa, with the intention of renewing it to a Student visa for Masters in 2008/2009, is this a breach of Immigration rules?
2.The Company also does not mind if after the 12 months, I start a Graduate job who will be willing too sponsor a work permit – so if while on the 12 months placement and I update my CV to include this job for Graduate jobs starting in 2008/2009 – is this lawful?
3.Could I apply for TRAINING AND WORK EXPERIENCE SCHEME to fill the 'gap' if the contract is to terminate on 23rd Nov 2008.
4.Is it a good idea to email Home Office asking them BEFORE or AFTER signing the contract?

Many thanks! Apologies for the long post.
