Visa required for the Mother of a british citizen

Post by Sonye » Wed Apr 01, 2015 12:40 pm

I need help from all those experienced and those of you that have been in my situation in the past. I have read through the threads and unfortunately have not found anything similar to my situation so i would appreciate it if you can point me to the right direcion.

I have applied for entrepreneural visa in the past but was not successful. I have now applied for a judicial review and waiting. But in the process of all these, I fell pregnant for my british partner. I have been told that my child will automatically be a citizen, but i would like to change my application after i give birth as I feel like i can be more employable with another type of visa. I know i will not be eligible for a british passport, but I would appreciate some advice on what to do and type of visa i could apply for. I will like to know what type of visa can the mother of a british citizen apply for and the requirements.

Thank you

Even as the mother of a British child a spouse visa application won't succeed if you're not married and an Unmarried Partner visa application will fail if you can't prove a minimum of 2 years co-habitation in a relationship 'akin to marriage'. Where is your partner living? How did he obtain his British Citizenship? By registration or passed down through relatives (by descent)?

Assuming you are currently living outside of the UK, you would have to show that your child is a UK resident and you are solely responsible for their primary care or the child is cared for by the father and you are applying for a visa to enable access.

Thank you for your response.
I am currently living in the UK. I am not married to my partner and I cannot prove 2 year co-habitation in the relationship as we never lived together. He is a british citizen by descent.
Please advise me if I will be eligible for a settlement visa and if it is flr(o), flr(m) or dlr that i will apply for.
thanks

FLR(FP) once your child is born but it's likely to be a long road. Do you currently have legal status in the UK?

flr fp application for parent and sole carer of a British ci

Post by Sonye » Thu Sep 03, 2015 9:02 am

Hi,
I would need the utmost advice from gurus. I just had a son. As his dad is british, he is automatically a British citizen. I have got his birth certificate signed by myself and his father, and I have also applied for a British passport.

I currently have a JR pending at the moment, but I would like to change to an application for leave to remain as a parent of a citizen. I also want to apply for a fee waiver. Any experts on this forum that could advice the documents I need to gather to help my application.

Thanks
