Hi Guys,

I am an overstayer but ready to go home and correct things.
Been with my partner for 5 and 1/2 years and for the last 5 have been living with him with no recourse to public funds etc , no criminal records etc app he is self employed and travels alot so apart from being a housewife , I also look after his admin.

Solicitor has advised that we can not apply for a COA as I have no visa , do you know if the HO is going to allow people like me to get married here soon based on the House of Lords rulling of course.

I have also been told that it doesn't make a diffrence if we are married or not as I will be applying for a settlement visa and in each case have to prove our relationship is genuine.

I am collating the documents needed for an unmarried partner visa and will state that I have been a housewife , does this help at all.

The solicitor will help me put an application together before I go out of the country.

Please advise.

If you have a solicitor, I am unsure why you need to ask here. Why not ask the solicitor? Isn't this what you are paying him for?

DANI, there have been a few cases recently (example) of the HO turning down spouse applications on the grounds that the applicant was once an over-stayer. Ask your solicitor if s/he is aware of this. If they aren't, you may to talk to one or two other firms to see if they are more up-to-date.
