COS denied

Post by calizzy » Wed Sep 09, 2015 1:13 am

Hi,
I am an American university professor. I was offered a job at a university in London beginning in December. The university has hired several Americans before and seems familiar with the COS process. They interviewed 6 applicants and I was the only American, so I believe they documented that they could find no British to fill the vacancy. They applied for the COS in August and it was denied. The school told me that they were told it was because the posting stated that salary was "depending on experience" and the home office wanted it to be specific. The school is frustrated because they have used the exact same phrasing on the last 3 posts where they hired Americans and never had a problem. They reposted the job with the new wording and are letting it run another 30 and will reapply in October. My questions is- is this type of denial common? Do I need to be worried that it won't go through? The fact that it has worked before and now is not passing worries me that immigration policies have gotten so tight that it will never pass.

Hello,

You mentioned that the job was reposted with the new wording and they are letting it run another 30 and will reapply in October.

What new wording does the new post has? State the exact wording.
Also, by 30, I take it that you mean 30 days?

there are specific requirement for resident labour market test (RLMT) to be conducted. They did not follow this and hence the cos was rejected. It is not a big deal and as soon as they have done the RLMT properly, and they aply for cos in next cycle, they should be able to get it. Getting a cos approved if everything is in order is based on point system, which in turn depends on various factors like job code, salary etc. higher the salary, more points and more likely to get a cos. you should not worry about it though, as things do seem to be going in the right order.
