Tier 2 extension and prorated salary

Can I apply for Tier 2 extension on the basis of 32.5 hours per week and pro rota salary ( for my SOC code salary requirement is £28,400 for 39 hours on 23.5 hours it comes to £23,666. I will getting £24k at the time of my extension. Is that enough?

as none replied your thread, im trying give you some hints. Though im not fully sure, probably home office only consider full time position which is over 39 hours. You must still recheck this info.

Thanks Rony for replying. not sure why experts not replying to my post.

I know that applicant can apply for 35 hours as well, my last application was based on 37.5 hours. Not sure about 32.5 hours as my company is not happy to increase my salary to meet £28400 but happy to reduce my hours to 32.5

A prorated salary of 32.5 hours per week is fine.

But the question is: are you extending with the same company that you initially got tier 2 for?

Yes I am extending with same company and they thinking to reduce my hours eiher to 32.5 or 35 hours as they are not willing to pay salary I need for 37.5 hours.

To be honest, I am not sure if the home office will question the fact that you are extending with the same company and your hours will be lower than your first leave.

Why don't you call the employer helpline and ask? Behave like an employer and ask. The number is: 0300 123 4699

Another thing you need to be thinking about is your salary for ILR if you plan to go down that route.

If you do apply for ILR, at the time of applying, you will need a gross annual salary of at least:
(_a) £35,000 if applying on or after 6 April 2016,
(_b) £35,500 if applying on or after 6 April 2018,
(_c) £35,800 if applying on or after 6 April 2019,
(_d) £36,200 if applying on or after 6 April 2020

Practice in Appendix J, or

(_d) £36,200 if applying on or after 6 April 2020

***Whichever is higher,*** where the appropriate rate or salary includes basic pay and
allowances as set out in paragraph 79E or paragraph 100A of Appendix A.

Thanks lucky, on Tier 2 I will due ILR in March 2017 but I may apply on 10 years basis next august. regarding hours I have discussed with my employer and we agreed on salary + bonus for 35 hours so I think now reducing hours from 37.5 is not big deal. if HO question that there can be lot of answers for that. i.e lunch break has increased from half an hour to one hour.
