New Marriage Allowance

Hi,

My wife is on a UK Spouse visa - she has been resident in the UK for ~ 6 months now.

She doesn't work so we want to apply for the new Marriage Allowance

(i.e. https://www.gov.uk/marriage-allowance-g ... w-it-works)

this will allow her to share £1060 of her Personal Allowance with me, saving me ~ £200 a year in tax.

Does anyone know if she is eligible to apply for this? her visa says 'No recourse to public funds' but I don't think this allowance comes under public funds.

Can anyone confirm before we apply?

She has to be working too....

1. You're married or in a civil partnership.

2. One of you needs to be earning £10,600 or less (not including any of your £5,000 tax-free savings interest).

3. The other one of you needs to be a basic-rate taxpayer (couples with a higher- or additional-rate taxpayer aren't eligible for this allowance).

4. Both of you must have been born after 6 April 1935.

Are you sure?

I read that you're still eligible if you're not working as you're still earning less than £10,600

That is £1060 of her Personal Allowance from Income Tax. That means that she needs to be earning and subject to Income Tax for her to transfer part of her allowance from Income Tax to you.

Your Personal Allowance is the income you don’t have to pay tax on - for most people it’s £10,600.
So, for your spouse to transfer her Personal Allowance, she needs to be earning that much income to transfer the personal allowance to you.
