Temporary admission (Over stayer in serious dilemma)

Post by in limbo in london » Wed Jan 29, 2014 4:22 pm

Hello
I am 36 ,Non EU Overstayer, arrived in Oct 2001 to United Kingdom legally, on a visitor visa , then applied for a student visa, which carried me into 2003 legally, then i went underground after that. for reaching my 14 year mark to apply for ILR ,That was bludgeoned when i ended a 5year love affair with a (PSYCHO)woman i was seeing at the time that knew of my Immigration status and reported me to UKBA, because i ended our relationship. shortly she let me know what she had done and without haste UKBA contacted me via post, i was immediately summonsed to an appointment at Becket House London bridge which would of ended in me been detained..

not familiar with the jargon or abbreviations been used on here , the PAP'S etc.. what does it all mean? all i know i that im at a stand still. lifeless and lost hope and looking to free myself from this emotional invisible exile.
My Solicitor is quiet, Home Office is quiet.. i have been waiting for 2 years on a decision based on the right to a family and private life, it was an FLR FORM that i filled out..im so stressed i cant remember dates and get alot of things mixed up in my head, as a result of this is down to my own ignorance and neglect. so far IN TOTAL £7000 pounds in cash and credit cards later , i have been issued with a removal which is pending. My Human rights application was refused on the grounds i am single and have no dependents, i live with my parents, they support me in every way. I am unable to sort even a voluntary position let alone proper employment.

i often turn to immigration forums and chat site like this but never had the nerve to register most times leave my computer even more deflated than when i came on, all the reading on different info does more harm to me, till now.. my frustration is beyond death itself.
I HAVE CONTACTED MY MP TWICE in march 2012 and Oct 2013, AND HE STILL kept saying he dosn't know me or has not met me in person &needs to know me longer than 2years , as this is the case he can not help me. my past correspondence with him is fruitless, i am drafting a new letter to him as i speak, but im in two minds and deflated as i know his response.
My solicitor milked me and my family to the bottom of the barrel we just about getting on, i was not happy with the approach in which my application was handled,a very text book manor, it was like she googled everything ,i was in too deep couldnt pull out alot of money had been pumped into this,at £150 an hour was her rate and still is. and after a lengthy wait of between 2012 to 2013 my application was rejected on not enough evidence on family life here .

My big question is how long can i wait till i get a response as its been two years since my application was rejected, as i have not had word for the past 7-8 months , i sign on (reporting ) at London Bridge branch Becket House once every 6 months and have been signing on for the past 3years.I was issued with a Notice of Removal and removal date was not given with only the right of appeal once the date had been set, A date of a decision for my Removal date was given ,but something went wrong with the timing of when the letter was sent out at Sheffield via post. my solicitor acted upon this and they went quiet and she too ended up going quiet, no ones said anything and all seems to be at a halt. Now on the 3rd of Jan 2014 i was issued with a Temporary Admission Notice. what happens now?

My family are all here parents , aunts and uncles ,cousins nephews nieces..all contributed with extensive material vouching for me positively and as i have no partner ,nor do i have children ,things look bleak and grey i do not know what lies ahead for me with all this uncertainty.

Any pointers please!!???

You will have to familiarize yourself with immigration laws, policies and caselaws also read up as much as you can so that you will not be taken advantages again in the future. It is better to be proactive and direct all your energy towards trying to solve your problem.

You can start here to read people with similar experience as yours and how they went about solving their problem. This thread is good place to start: http://www.immigrationboards.com/immigr ... -8740.html. Case laws here: http://www.bailii.org/form/search_cases.html.

Also look up UKBA website click on policy and law and then staff guidance and instructions. Read what criteria they use to decide cases like yours. Especially article 8,family or private life. As you are above 25 years and have not lived in UK for 20 years of your life. The only avenue still open up to you is to prove that all your socially, culturally and family ties are with UK and there is non meaningful ties left with your from your country of origin.

I was in the same dilemma for over 10yrs , until I meet a fierce solicitor who didn't charge millions and my nightmare was over.and get advice on your case. She'd tell you if you have a chance. I was her client for 13weeks and I got my leave to remain. I totally understand what you are talking about.

Firstly this thread is more than a year old. So, the OP is likely no longer following it.

Secondly, the issue is about staying in the UK. So it should be in the General Immigration Forum in the UK-Non-Tier section. Can the mods look at moving this thread?

Lastly, advertisement for (legal) services is not allowed on these forums.
